FEDERAL COURT RULES BLOGGERS HAVE 1ST AMENDMENT PROTECTIONS

 

For all of you bloggers, a Federal Appeals Court ruled that bloggers and the public have the same First Amendment protections as journalists when sued for defamation: If the issue is of public concern, plaintiffs have to prove negligence to win damages.

 

The 9th U.S. Circuit Court of Appeals ordered a new trial in a defamation lawsuit brought by an Oregon bankruptcy trustee against a Montana blogger who wrote online that the court-appointed trustee criminally mishandled a bankruptcy case.

 

The Circuit Court ruled that the trustee was not a public figure, which could have invoked an even higher standard of showing the writer acted with malice, but the issue was of public concern, so the negligence standard applied.

 

THE FACTS

 

 Crystal L. Cox, a blogger who was from Eureka, Montana was sued for defamation by Bend attorney Kevin Padrick and his company, Obsidian Finance Group LLC after she made posts on several websites she created accusing them of fraud, corruption, money laundering and other illegal activities.  The appeals court noted Padrick and Obsidian were hired by Summit Accommodations to advise them before filing for bankruptcy, and that the U.S. Bankruptcy Court later appointed Padrick trustee in the Chapter 11 case.  The court added that Summit had defrauded investors in its real estate operations through a Ponzi scheme.

 

A jury in 2011 had awarded Padrick and Obsidian $2.5 million.

 

The 9th Circuit held that liability for a defamatory blog post involving a matter of public concern cannot be imposed without proof of fault and actual damages:.

 

The appeals court upheld rulings by the District Court that other posts by Cox were constitutionally protected opinion.

 

Attorneys for Padrick stated that “Ms. Cox false and defamatory statements have caused substantial damages to our clients, and we are evaluating our options with respect to the court’s decision”, wrote Steven M. Wilker.

JUDGE RULES THAT TEXAS SCHOOL CAN FORCE TO WEAR TEENAGERS TO WEAR LOCATOR CHIP


A Federal Judge ruled that a San Antonio Texas public school district can require students to wear a locator chip when they are on school property, in a case raising technology-driven privacy concerns among liberal and conservative groups alike.

U.S. District Court Judge Orlando Garcia said the San Antonio Northside School District had the right to expel sophomore Andrea Hernandez, 15, from a magnet school at Jay High School, because she refused to wear the device, which is required of all students.

The judge refused the student’s request to block the district from removing her from the school while the case works its way through the federal courts.

The ACLU is among the rights organizations to oppose the district’s use of radio frequency identification, or RFID, technology.

The school district-which is the fourth largest in Texas with about 100,000 students is not attempting to track or regulate students’ activities, or spy on them, the district spokesman said. Northside is using the technology to locate students who are in the school building but not in the classroom when the morning bell rings, the spokesman said.

Texas law counts a student present for purpose of distributing state aid to education funds based of the number of pupils in the classroom at the start of the day. Northside said it was losing $1.7 million a year due to students loitering in the starirwells or chatting in the hallways.

The software works only within in the walls of the school building, cannot track the movements of the students, and does not allow students to be monitored by third parties, according to the school district spokesman Pascual Gonzalez.

The ruling gave Hernandez and her father until the start of the spring semester later this month to decide whether to accept district policy and remain at the magnet school or return to her home campus, where RFID chips are not accepted.

The Rutherford Institute, a conservative Virginia based policy center that represented Hernandez in her federal court case, said the ruling violated the student’s constitutional right to privacy, and vowed to appeal.

As a Presidential candidate in 2008, Obama promised that he would focus on creating “jobs that pay well and can’t be outsourced”.  To date billions of dollars have been spent to create jobs. All these jobs have been outsourced or spent overseas.

Swiss-based Landis+Gyr Received over $50 million in stimulus contracts for their Smart Grid Meters, Cathy Zoi, a former Obama Energy Department Official, Held over $250,000 worth of stock in the company as they profited from her department’s policies.

North Carolina-based LED maker Cree Inc received over $39 million through the Stimulus and later opened its First Plant in China.  Over half of the company’s employees are now located in China and Cree’s CEO  says the company ‘s strategy is “Cree Chip, China Heart”

Subsidiaries of Danish Wind Mill Maker Vestas Received $51.6 Million in stimulus Grants to build U.S. based factories.  They have announced plans to layoff 180 U.S. Workers and possibly another 1,600 by the end of the year.

After taking a taxpayer-funded bailout, General Motors opened a $200 million Plant in Thailand to supply diesel engines for the Chevrolet Colorado Pickup truck.

Double Standard in Media

 Voters today need to start realizing that there is a double standard and bias in the media today.

 On Tuesday August 14th, 2012 Vice President Joe Biden told supporters that Republicans would “put y’all back in chains” during a campaign speech Tuesday in Virginia.

VP Biden stated: They’re said it.  Every Republican’s voted for it.  Look at what they value and look at their budget and what they’re proposing.  Romney wants to let the-he said in the first 100 days, he’s going to let the big banks once again write their own rules-unchain Wall Street. They’re going to put y’ all back in chains.  He said he’s going to do nothing about stopping the practice of outsourcing

The Romney campaign has called these comments “not acceptable” in a statement that was released shortly after Biden’s speech

President Obama stated that he has no problem with VP Joe Biden’s comments.

Now if an Republican candidate made these statements the left wing media would be all of this.  They would be calling the candidate to step down and quite the race.  And the would also be calling them racist.

 How come the left wing media is not making a big deal of this?  How come they are letting the VP Biden getting away with these statements

RECENT COLD CASES THAT WERE SOLVED IN CALIFORNIA

On April 20, 2012, a 51 year old Northern California man allegedly linked to the 1981 rape-murder cold case of a Whittier women is expected was arraigned in court.

Joseph Allen Thornton of Auburn, California was charged with one count of murder with special circumstance allegation of rape.

The defendant was arrested by the Whittier PD on April 18th, 2012, at his residence, is accused of raping and killing Blanca Stella Negrete, 21, on June 27, 1981.

Whittier police department re-opened the 30 year old cold case in May of 2010 and identified the defendant through a DNA hit on the Combined DNA Index System, the statewide DNA database.

Joseph Allen Thornton is being held without bail.  If convicted as charged, he faces life in prison without parole or the death penalty.  The DA office will announce at a later date whether it will seek the death penalty against the defendant.

CALIFORNIA DEATH ROW INMATE PLEADS TO 1989 LONG BEACH WILSON HIGH MURDER

On April 18, 2012 a California death row inmate pleaded guilty to the 1989 strangulation of a 15 year old Wilson High School sophomore.

Royal Clark, 50, will be sentenced to life in prison without possibility of parole.  Clark pleaded guilty to the first-degree murder of Danielle Marie Haddon on October 30, 1989, and admitted that he used an electric cord to strangle her to death. He admitted the special circumstance of prior murder conviction.  In exchange for his plea, prosecution agreed not seek the death penalty.

Prosecutors say that on the night of October 29, 1989, Haddon was alone in the apartment that she shared with her grandmother and was talking on the phone with a friend when she said she had to answer a knock on the door.

Her body was discovered inside the apartment in the 1000 block of Coronado Avenue early the next morning after her grandmother returned home from work. DNA collected from her body at the time was matched to Clark’s DNA.

Los Angeles Man charged in Fatal shooting in 1990 Cold Case Murder.

Michael James Tharrington  is charged with one count of capital murder, one count of attempted murder and two counts of second-degree robbery.  The felony complaint includes the special circumstance that he committed the murder during a robbery.

Michael Tharrington is charged with fatally shooting Ann Yao, 31, on Feb 10, 1990. Yao was sitting in her car parked on Lucernce Avenue south of Wilshire Blvd.   when she was shot once in the head.  Tharrington also is charged with shooting the male passenger sitting in her car  and stealing his car that was parked nearby.

SIMPSONS BAN FROM THE COUNTRY OF IRAN

The Institute for the Intellecutal Development of Children and Youth Adults have banned the sale of the Simpson Dolls. They would not say why they were having the dolls banned, but they did say that any dolls that had distinguishable adult genitals, or any dolls of adults at all, were banned “because these dolls are promoters of Western culture.”

But the Institute is allowing for the sale of Spiderman and Superman dolls. Mr. Mohammad Hossein Farjoo said that these dolls were authorized for sale. These dolls were allowed for sale because they helped the “opposed”

TOP UNSLOVED HOLLYWOOD MYSTERIES

Back on November 17th, 2011 the Los Angeles County Sheriff’s Department decided to re-open the Natalie Wood case after 30 years of being closed.

Here is a list of some of Hollywood’s unsolved crimes.

 

  1.  Elizabeth Short-The Black Dahlia

 

On January 15th, 1947, Elizabeth Short, a 24 year old aspirn  actress with long, dark hair and blue eyes was found brutally murdered in an empty lot in the Leimert Park district of Los Angeles.  Her corpse had been severed at the waist and drained of blood and her face was slashed from the corners of her mouth to her ears.

 2.  George Reeves- Superman

In 19451, George Reeves became Superman on T.V. After the series left TV Reeves had trouble finding work was in dire financial straits due to his expensive lifestyle.  According to the Los Angeles Police department reports between the hours of 1:20 and 2:00 am on June 16th, 1959, Reeves reportedly shot himself in is head in his upstairs bedroom at his Los Angeles home.  His financee, playwright Leonore Lemmon, and his friends William Bliss, writer Robert Condon and Carol Van Ronket.  During the party, the houseguest’s head a single gunshot and William Bliss ran into the room to find Reeves naked body laying face up with a gun between his feet on the floor.Through the years it has been rumored that George Reeves former Girlfriend, Toni Mannix ordered the hit on Reeves life after their break up.  Toni Mannix died from Alzheimer Disease in 1983, but in 1999 Edward Lozzi a Los Angeles publicist said that Mannix confessed to him that she told a priest that she was responsible for his death.

3. Bruce Lee

On July 23, 1973, 32 years old Bruce Lee was found dead of an apparent allegric reaction to equaqesic, a painkiller.

Six days before his release of his last movie, Bruce Lee met with producer Raymone Chew to discuss a new film project.  Also at the meeting was Taiwanese actress, Betty Ting Pei, when Lee complained of a headache, Pei allegedly gave him a equaqesic- a combination of aspirin and a muscle relaxant.  Bruce Lee then decided to take a nap, he would never wake up.

Many claims made through the years was that Lee was either murder by Triads, that he died from a Dim Mak(“Death strike”) that he received some time earlier or that his family is simply cursed. 

Today, many people simply believe that his family his cursed.  On March 31, 1993 his son Brandon Lee was accidental shot to death while filming his character’s death in the film, The Crow.

 4. Marilyn Monroe

August 5th, 1962, 36 year old Marilyn Monroe was found dead in her home after overdosing on barbiturates.  Her death was listed as suicide.

 According to the corner’s report there was no trace or drugs in her stomach.  She was covered in bruises, including a major one to her hip.

 The toxicologist wanted to examine her organs and blood to see how the drugs got into her system, but after the initial exam, Monroe’s organs were destroyed.

Many people have doubt throughout the years that Marilyn Monroe committed suicide.  At the time of death, Monroe was allegedly involved in a relationship with John F. Kennedy and perhaps even his brother Robert F. Kennedy.

5.David Carradine

On June 4th, 2009, David Carradine was found dead in his hotel room in Bangkok, where he was shooting a movie.  The actor’s body was found hanging in the closet with a rope tied to his neck, wrists and genitals in an apparent act of autperotic asphyxiation.

6. Bob Crane

The former “Hogan Hero” star was murdered on June 29th, 1978, allegedly bludgeoned to death with what might have been a camera tripod.  Bob Crane had a voracious sexual appetite and often filmed his escaped with the help of a man named John Henry Carpenter, who police suspected of his death.

7. Thelma Todd

Between 1926 and 1935, Thelma Todd appeared in over 120 films.  On December 16, 1935, Todd was found dead in the garage of actress Jewel Carmen, the former wife of Todd’s lover and business partner.  The cause of death was carbon monoxide poisoning.

Police found that Todd had spent the night before her death at a popular Hollywood restaurant, where she had an argument with her ex-husband; she then retreated to Carmen’s home, which was a block away from a restaurant that she owned.

Todd’s body was cremated, but blood was found on her head and dress, leading some to believe she was knocked unconscious before her death. Todd’s ex-husband was murdered two years later.

Special message to our troops for Veterans Day


United States President Woodrow Wilson first proclaimed an Armistic Day for November 11, 1919. In proclaiming the holiday he said:

 “To us in America, the reflections of Armistic Day will be filled with solemn pride in the heroism of those who died in the country’s service and with gratitude for the victory, both because of the thing from which it has freed us and because of the opportunity it has given America to show her sympathy with peace and justice in the councils of the nations”.

 June 4th, 1926, Congress requested that President Calvin Coolidge issue another proclamation to observe November 11 with appropriate ceremonies.

An act approved May 13, 1938 made the 11th of November in each year a legal holiday; a day to be dedicated to the cause of world peace and to be thereafter celebrated and known as “Armistice Day”. Congress amended this act on June 1, 1954, replacing “Armistice” with “Veterans”.

On Veterans day of this year lets take the time to thank our veterans who have served our county both here in the United States and throughout the world. We should never take our freedom for granted. Because of our soldiers sacrifice and courage we can live in the land of the home of the land and the free.

Today, I would like to take the time to say thank you to all of our soldiers.

Thank you for all of the sacrifices that you have made.

Thank you for putting your lives on the line every day to protect us from danger.

May God Bless you and May God Bless the United States of America.
